Texas categorizes misdemeanors into three classes: A, B, and C.
- Class A misdemeanors are punishable by up to 1 year in county jail, and up to a $4,000 fine. Certain Class A misdemeanors can also cause your driver’s license to be suspended, or disqualify you from carrying a firearm.
- Class B misdemeanors are punishable by up to 180 days in the county jail, and up to a $2,000 fine. Some of the most common Class B misdemeanors are DWI (first offense), Possession of Marijuana Under Two Ounces, Theft between $50-$500, and Driving While License Invalid.
- Class C misdemeanors are not punishable by jail time, but may require a fine up to $500. These include tickets for traffic offenses, Public Intoxication, Simple Assault, and Possession of Drug Paraphernalia.
Although misdemeanor crimes carry a less severe punishment than felonies, a misdemeanor conviction can still have a significant negative affect on a person’s future. For example, many employers will not hire a person with a DWI or drug conviction. Further, many schools will deny a student’s application based on their criminal history.
